Asian homelands and in its religion and worldly life. No Arab other than a traitor to his people and homeland, and no Muslim who believes in God Most High, His mighty Book, and His Messenger Muḥammad, Seal of the Prophets, God’s blessings upon him, his family, and his companions, can conceivably assist them in it. Every Muslim must instead exert every effort within his power to resist this conquest, with the obligation more emphatic upon those nearer to it. The least onerous means and methods of resistance consist of passive resistance, and the easiest is refusing to sell the homeland’s land to Jews. This is less than all that is required in jihad with wealth and life, the same kind of struggle they themselves wage to strip us of our lands and sovereignty.

It is established in the law that, if they take it, Muslims as a whole must expend their property and persons in order to restore it. Can it be conceived that this law would permit us to prepare the way for their possession of it by taking a sum of money from them—which is certain—only to obligate us to expend many times that sum together with lives in order to restore it—which is uncertain? Restoration depends upon the unity of the Arab nation and the renewal of its strength by modern methods. How can it achieve that while the heart of its lands and the arteries carrying its lifeblood are in another’s grasp? A person who sells his land to Jews in Palestine or Transjordan is therefore counted as an offender against the entire Arab nation, not Palestine alone.

Poverty and need for money excuse no one. The law permits otherwise forbidden begging in severe need, permits carrion, blood, and pork to be eaten under compulsion, and may permit seizure or theft of the loaf that sustains life and saves the hungry person from death, with the intention of compensation. Yet this law does not permit a Muslim to sell his country and betray his homeland and religious community in order to support his dependents, even if he reaches the degree of compulsion. Suppose that the compulsion to obtain life-sustaining food reaches such a point that it cannot be relieved except by selling to Jews or by other kinds of betrayal. The compulsion that permits prohibitions such as those we have mentioned is something that befalls a person on the brink of death from hunger; it is relieved by a single loaf, for example, and has many avenues and means of relief.

I believe that those who sold them their land did not know that selling it was a betrayal of God, His Messenger, His religion, and the entire nation, like the wartime betrayal of joining the enemies in giving them possession of the Abode of Islam and humiliating its people. This is the gravest kind of betrayal.

O you who believe, do not betray God and the Messenger, or betray your trusts knowingly. And know that your wealth and your children are a trial, and that with God is a great reward. (Qurʾan 8:27–28)

Analysis

Riḍā's answer continues from printed page 274. He urges Muslims to resist, rejects even severe poverty as an excuse for selling land to יהודים YEHUDIM, and calls sellers traitors to God, Islam, and the Arab nation. His Qurʾanic quotation supports his appeal within his argument; it does not independently prove the historical accusations. The page establishes the scope of his published condemnation. It does not show that a court applied the ruling, that a seller was punished, or that a sale was prevented. The next separately titled fatwa begins on the following annual-volume image and is outside this record.
